This privacy notice describes how and why Mvmtology, LLC (hereinafter “Mvmtology”, “Company”, “we”, “us”, or “our”) might collect, store, use and/or share (“process”) your information when you:

  • visit or use our website, its sub-domains, and affiliated sites; other linked and related sites; our pages and accounts on Facebook®, Instagram®, LinkedIn®, and YouTube® (“Site”).

  • engage in physical therapy, pelvic health physical therapy, and/or Pilates instruction with the Company including the use of scheduling or registration services and email opt-ins (“Services”).

  • engage with us in other related ways, including any sales, marketing, or events.

  • engage with us in any combination of the above (“Practice Offerings”).

Collection of your Personal Information

Unless noted otherwise, Mvmtology does not collect personal identifiable information from users of our Practice Offerings.

When you visit our Site, some information such as your Internet Protocol (IP) address, browser and device characteristics, domain name, access time, language preferences, location, operating system, how and when you use our Site, referring website addresses, and other technical information is automatically collected. Most of our Site does not require any form of registration, allowing you to visit our Site without disclosing personally identifiable information. However, some services, such as email opt-ins and client registration may require you to provide us with personally identifiable information such as your name, phone number, email address, credit card information, and medical or health information. If you choose not to provide personally identifiable information, you may not be able to access certain parts of our Site. When you engage with any Practice Offering, you consent to our collecting personally identifiable information for purposes as described in this Privacy Policy.

Use of Your Personal Information

If we obtain any personally identifiable information from you, we will not willingly share your information with companies outside our organization, except as described in this Privacy Policy. The information we gather from you may be used in several ways, either now or in the future, to gain a better understanding of users and their usage pattern as a whole, for Site administration and troubleshooting, to process transactions, contest entries and other matters you initiate, to identify preferences in content and advertising, to target editorial, for advertising or other content (such as promotions, special offers, etc.) we think might be of interest to you. We may also use information gathered from you to communicate changes and improvements to our Practice Offerings or to any registration you have made. We may also use personally identifiable information for matters related to scheduling, payment processing, and providing treatment or instruction. When you participate in any Practice Offering, you consent to our using personally identifiable information for purposes as described in this Privacy Policy.

Age of Consent

Our Practice Offerings are not intended for, nor do we collect or maintain information from individuals under the age of 18. We do not knowingly solicit from nor market to children under 18 years of age. If you are under 18, you may only use our Practice Offerings under the supervision of a parent or guardian. If we discover or are otherwise notified that we have received any such information from users less than 18 years of age in violation of this policy, we will delete that information. If you become aware of any data we may have collected from children under the age of 18, please contact us directly.

Withdrawal of Consent

If after you opt-in or participate in Practice Offerings, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use, or disclosure of your information, at any time, by contacting us directly.

Disclosure of Information

We may disclose personal information (i) if it’s in response to a legal process, e.g. in response to a court order or subpoena, or in response to a law enforcement agency’s requests, (ii) to receive payments from you, (iii) in response to a charge-back inquiry from our merchant bank about your payment for Services, (iv) to third parties that work with us in order to provide you with Practice Offerings, (v) if you violate our Terms and Conditions, (vi) to plan and/or provide your care and treatment, (vii) to communicate with other providers such as referring physicians, (viii) to make you aware of services and treatments that may be of interest to you. We also may disclose total aggregated user statistics in order to describe our services to potential advertisers, other third parties and affiliate companies, and for other lawful purposes.

Payment

If you make a purchase through our Site, we use a third-party payment processor, Stripe. Payments are encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as it is necessary to complete your purchase transaction. We do not have access to the information that you furnish to the third-party payment processor. We are not responsible for any use or misuse of the information by the processor. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our Site and its service providers.

Security

No method of transmission over the Internet or electronic storage is 100% secure. To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered, or destroyed.

Cookies

We collect cookies or similar tracking technologies. When you engage with our Site, we automatically receive your internet protocol (IP) address(es) in order to gather information that helps us learn about your browser, operating system, and network. We collect non-personally identifiable information about you in several ways, including tracking your activities through your IP address, device characteristic, embedded scripts, time and date of contact, tracking metrics, or most-recently visited URL. This information can be used to track your session with our Site. Cookies may also be used to customize our Site content for you as an individual. We do not collect any personally identifiable information about you unless you voluntarily submit such information to us, by, for example, filling out a survey or registration form.  If you are using one of the common Internet web browsers, you can set up your browser to either let you know when you receive a cookie or to deny cookie access to your computer.

Web Analysis Tools

We may use web analysis tools that are built into Site to measure and collect anonymous session information.

Use of Third-Party Services

We use trusted third-party systems as our data processors for technical and organizational purposes, including for payments, e-commerce platform, and email marketing. In general, the third-party providers used by us will only collect, use, and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the way your personal information will be handled by these providers. Remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. If you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. When you click on links within our Site, they may direct you away from our Site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

Limitations

By using our Practice Offerings you agree that the Company is not responsible for (i) any disclosure of your personal information made by you to a third party through your use of our Practice Offerings; (ii) any disclosure of your personal information obtained illegally from the Company; or (iii) any accidental disclosure of your personal information made by the Company.

Data Retention

We only retain Personal Data collected from you for as long as your account is active or otherwise for a limited period of time as long as we need it to fulfill the purposes for which we have initially collected it unless otherwise required by law. We will retain and use information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements for a period of 10 years.

Policy Changes

We reserve the right to modify this Privacy Policy at any time, so please review it frequently. All modifications will be effective immediately upon their posting on the Site. We will take steps to notify users of any modifications; however, you are responsible for reviewing any modified terms. When updates are made to our Privacy Policy, the date of revisions will be noted at the top of this Privacy Policy. Your continued use of our Practice Offerings following any changes constitutes your agreement to such changes.

Acknowledgement of Receipt and Understanding

This Privacy Policy is incorporated into and considered part of our Terms and Conditions (www.mvmtology.com/terms) and any contract you may sign with the Company. By using our Practice Offerings, you are consenting to this Privacy Policy. If you do not agree with our policies and practices, please do not engage with our Practice Offerings.
